Terms and Conditions for Real Kansas Meats Bulk Beef Program

These Terms and Conditions (“Terms”) govern your participation in the Real Kansas Meats (“RKM,” “we,” “us,” or “our”) Bulk Beef Purchase Program (the “Program”). By reserving a half or whole beef through the Program and making any payment, you (“Customer,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, do not make a purchase through the Program.
Program Description
The Program allows Customers to reserve a half or whole beef by committing to purchase up to 16 months in advance of slaughter. This secures access to high-quality beef processed according to your specifications, subject to our processing guidelines. Reservations are subject to availability and animal readiness.
You may select the beef quality (e.g., Prime, Choice), type (e.g., Wagyu, Certified Angus Beef), and participation in the Traceability Program or other value-added programs as described on our website at (https://realkansasmeats.com/programs/). Selections must be made at the time of your initial order or as otherwise specified. Grass-fed beef is excluded from this Program unless explicitly offered.
All beef is sourced from cattle meeting applicable program standards, including grading, phenotypic/genotypic requirements, diet, health protocols, and traceability where selected. We reserve the right to substitute equivalent quality beef if your selected specifications cannot be met due to animal performance or availability.
Payment Terms
Upon reservation, you must select one of the following payment options:
Option 1: Pay Estimate in Full + Reconciliation
– Pay Estimate: Pay the estimated price in full via the online store using approved payment methods.
– Reconciliation: At slaughter, final price is calculated using current market price per pound (live weight). You pay any remaining balance within 7 days before pickup. Overpayments are refunded within 14 days.
Option 2: Shop Pay Installments + Reconciliation
– Installments: Complete checkout via the online store and select Shop Pay Installments. Complete the verification process and select your payment preferences through Shop Pay. Availability of installment options are determined by the Shop Pay verification system and are not subject to Real Kansas Meats’ control. Installment payments will be collected by Shop Pay.
– Reconciliation: At slaughter, final price is calculated using current market price per pound (live weight). You pay the remaining balance within 7 days before pickup. Overpayments are refunded within 14 days.
Payments must be made via approved methods (e.g., credit card, ACH). Late payments may incur fees up to 1.5% per month or the maximum allowed by law. All payments are in U.S. dollars.
Pricing and Costs
Estimated Live Weights and Pricing:
– Half Beef: 600–700 lbs at approximately $2.50/lb live weight (subject to market changes).
– Whole Beef: 1,200–1,400 lbs at approximately $2.50/lb live weight (subject to market changes).
Processing Fees
Paid directly to the processor at slaughter, estimated $0.80–$1.20/lb hanging weight, based on your specifications and included in the Reconciliation as set forth in Option 1 or Option 2 in Paragraph 2 above.
Additional Costs
You are responsible for any taxes, shipping, delivery fees, or storage costs if applicable. Estimates are for planning only and may vary due to market fluctuations, actual weights, or program premiums.
Final pricing includes any applicable premiums for selected programs (e.g., 2-16% for Wagyu, 2-15% for All-Natural). We are not liable for market price volatility, and you bear the risk of increases.
Slaughter, Processing, and Delivery
Slaughter Date:
Estimated at agreement signing, subject to change based on animal readiness, health, or processor availability. We provide at least 14 days’ notice of the final date.
Processing Instructions
Submit cuts, packaging, and other preferences at least 14 days before slaughter. Failure to do so results in standard processing at your expense.
Delivery/Pickup
You must pick up processed beef at the designated facility. Alternative arrangements (e.g., shipping) may incur additional fees, which you agree to pay in advance. Risk of loss transfers to you upon pickup or shipment.
Quality Assurance
Beef must meet USDA grading standards for selected programs.
Defaults, Cancellations, and Buyback
Default
Failure to pay the reconciliation balance within 7 days of invoice constitutes default.
Buyback Option
In case of default, we may repurchase the animal at the total amount you’ve paid minus a 10% administrative fee based on live weight price at slaughter. Payment issued within 30 days. You forfeit all rights to the animal upon buyback.
Cancellations
The down payment is non-refundable except in buyback scenarios. No cancellations after agreement signing unless we cannot fulfill due to force majeure (e.g., natural disasters, regulatory changes), in which case we refund payments minus reasonable costs incurred. If you purchased under the Shop Pay Installment Program, you are subject to the terms of such program’s cancellation and refund policy.
Program Removal
If selected cattle fail program compliance (e.g., audits, health standards), we may remove them and adjust pricing accordingly.
Data and Privacy
Where the Traceability Program is selected, animal data (e.g., health, genetics) is tracked from birth to packaging. We do not share your personal or order-specific data with third parties except as required by law or for program verification. For producer-related data policies, refer to our website.
Limitations of Liability and Disclaimers
The Company’s liability for any claims arising from the purchase or use of its beef products shall be limited to the purchase price paid for the specific products giving rise to the claim. The Company makes no warranties, express or implied, beyond those required by law, and specifically disclaims any liability for damages arising from improper handling, storage, preparation, or cooking of products after delivery. The Company shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, business interruption, or personal injury, regardless of the theory of liability.
Purchaser acknowledges that beef products are perishable and must be handled in accordance with proper food safety practices, including maintaining appropriate refrigeration temperatures, cooking to safe internal temperatures as indicated on product labeling, and consuming products before expiration dates.
The Company’s liability is expressly conditioned upon Purchaser’s compliance with all handling instructions, storage requirements, and safety warnings provided by the Company. Any claims must be reported to the Company in writing within forty-eight (48) hours of discovery, and failure to provide such notice shall bar any recovery.
Force Majeure
We are not liable for delays or failures due to events beyond our control including but not limited to disease, natural disasters, supply shortages, pandemics, strikes, etc.
Governing Law and Dispute Resolution
These Terms are governed by Kansas law. Disputes shall be resolved through binding arbitration in Kansas under AAA rules, or in state/federal courts in Shawnee County, Kansas if arbitration is unenforceable. You hereby waive all class action rights.
Miscellaneous
Amendments
We may update these Terms with notice via email or website. Continued participation constitutes acceptance.
Severability
Invalid provisions do not affect other provisions.
Entire Agreement
These Terms, your purchase agreement, and website program descriptions form the full agreement.
